By accessing or using the California Building Industry Research Data Explorer web application (the “Service”), operated by the California Building Industry Research organization (“consol.org,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
The California Building Industry Research Data Explorer is a web-based platform that provides aggregated analysis and visualization of California CHEERS CF2R building energy compliance data. The Service covers domains including HVAC, fenestration, insulation, water heating, solar PV, battery storage, and all-electric analysis.
The Service is designed for building industry research purposes and presents only aggregated, server-side computed data. No raw or record-level compliance data is exposed to end users.
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Access to the Service requires a registered account. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
The Service operates on a subscription basis. Payments are processed through Stripe. By subscribing, you agree to the following:
We reserve the right to change subscription pricing with at least 30 days’ notice. Price changes will take effect at the start of your next billing cycle following the notice period.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
The Service, including its design, functionality, aggregation methodology, software, charts, visualizations, and all associated content, is owned by consol.org and protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.
The California CHEERS CF2R compliance data processed by the Service is derived from publicly regulated compliance records. Our proprietary interest lies in our extraction methodology, data processing pipeline, aggregation logic, and analytical presentation—not in the underlying public compliance data itself.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal research and business purposes. This license does not include the right to sublicense, resell, or distribute the Service or its outputs.
We collect and process personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
We implement commercially reasonable security measures to protect your account information. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

The data presented through the Service is derived from third-party compliance records and is provided for informational and research purposes only. It should not be relied upon as the sole basis for building code compliance decisions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSOL.ORG, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
Sections 6 through 14 of these Terms shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered in Sacramento County, California, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs of arbitration.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and consol.org regarding the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction.
Force Majeure. We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
